Irgendwo wird sie sicherlich ihre Berechtigung haben, aber in der Praxis hat sie zumindest uns vor allem Schwierigkeiten bereitet.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Wegesicherungspflicht bedeutet, dass der\/die Besitzer*in (Eigent\u00fcmer*in, P\u00e4cher*in, evtl. auch Mieter*in) eines Grundst\u00fccks oder Hauses rechtlich daf\u00fcr verantwortlich ist, dass dort keine Gefahrenquellen f\u00fcr Dritte (also andere Nutzer*innen) vorhanden sind. Anders gesagt: sobald jemand sein Grundst\u00fcck f\u00fcr Andere \u00f6ffnet, ist die Person (bis zu einem gewissen Grad) haftbar, wenn sich jemand dort verletzt. Viele Eigent\u00fcmer*innen reagieren darauf sehr simpel: Aus Angst vor rechtlichen Risiken sperren sie ihr Grundst\u00fcck ab, so dass niemand es betreten oder nutzen darf. Manchmal entstehen so \u00f6kologisch wertvolle Brachen, oft auch nur ungenutzte, weil unnutzbare Brachen.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">Im Namen aller Stadtmacher*innen: Verklagt bitte nicht automatisch Alles und Jede*n!<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Wegesicherungspflicht ist eine gesetzliche Vorschrift, dementsprechend wenig Einfluss hat man darauf. Unser Umgang damit: Wenn eine*e Eigent\u00fcmer*in nicht daran denkt &#8211; weist ihn\/sie nicht darauf hin, weckt keine schlafenden Hunde, schafft keinen Anlass zu Sorgen. Baut\/pflanzt so, dass daraus kein Risiko f\u00fcr andere entsteht. Nutzt euren gesunden Menschenverstand und lasst euch nicht von einer genialen Idee zu etwas Dummen hinrei\u00dfen (es sei denn, sie ist wirklich, wirklich, wirklich gut &#8211; dann vielleicht). Verletzt euch nicht und im Namen aller Stadtmacher*innen: Verklagt bitte nicht automatisch Alles und Jede*n, wenn ihr euch auf einer umgenutzten Brache das Knie aufkratzt.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Wie ihr vermutlich gemerkt habt: Wir sind keine Jurist*innen. Wenn ihr mit eurem Projekt \u201ehart am Wind segelt\u201d bzw. in eine Grauzone kommt, holt euch echten juristischen Rat, das ist weniger teuer als man denkt.
